			<description><![CDATA[ I really have no idea of what else to say...<br>

Sounds like you tried to get it covered under something but maybe this was just one of the cases where the cracks were really canyons .<br>
It seems funny though that everyone was not able to help. Kind of shows how things tend to <strong>"not be our responsibilty</strong>" when they are supposed to enforce the required rules.<br>
I do find it hard though to believe that this could of been (at least to the truck owner) a throw away deal.  Just go get something newer and keep going... That suprises me.<br>

Now I do not know everything about the billing under the liability coverage as I have not pony'd up the big bucks to attend the class which is out there... Maybe when I win the lottery I will do that. But I am a driver first and have to spend my money carefully.. ]]></description>

			<description><![CDATA[ Failure.&nbsp;&nbsp;<br><br>Tractor &amp; loaded trailer recovered from a public waterway.&nbsp; Driver contact was odd and despite the many,many hours on-scene, no company or insurance company ever called, so we checked insurance status before we invoiced -&nbsp;appeared to be liability only so we were careful.&nbsp; Very carefully worded invoice &amp; description &amp; lots of pictures.&nbsp; Total loss.&nbsp; No one called.&nbsp; At all.&nbsp;&nbsp;We tracked down&nbsp;a few folks, rattled a few chains.&nbsp; Still nothing.&nbsp; Went to insurance oversight commission in two states, contacted feds, asked for help from state agencies (lots of folks on scene for this one).&nbsp; Nothing.&nbsp; Even the EPA wasn't&nbsp;following up.&nbsp; Thought of taking&nbsp;them to court.&nbsp; Local attorneys didn't know where to start.&nbsp; Tried to get McGovern's help.&nbsp; Still nothing.&nbsp; This was a big one, lots of lost resources.&nbsp; Law enforcement told us the same driver was... ]]></description>

			<description><![CDATA[ I just had another success with the help of a letter explaining why this was a liability claim. The most promising point was that this happened with an insurance co we and many others we know have had problems with in the past. As a matter of fact this is the first one I tried regarding private property versus public.<br>
<br>
The initial response was "towing is not covered under his policy". I asked her to please show me where on my invoice it said anything about towing. I told her that I would write her a letter explaining why this invoice qualifies for payment under liability. I wrote the letter, sent the photos and in about an hour she called back and said "you've got me, I can't see any reason I can deny this claim when its explained this way". Ten days later I was paid in full.<br>

One thing I can't figure out. They seem less likely to pick up the load and trucks when paid in this manner. I wonder why. ]]></description>

			<description><![CDATA[ Got my answer yesterday. The State Ins Commission ruled that The Ins was responsible for removing the vehicle frtom the building. Ins co agreed but showed that
policy limits had already been exceeded and therefore payed nothing. Owner has left state with no forwarding info and I got a nice piece of junk in the lot. I
at least received an answer that I can use in the future to maybe get paid early in the game before all policy limit money is disbursed.

			<description><![CDATA[ I am glad to see others having success. We have had some success and it all seems to hinge on who you are explaining the charges to. I had one guy who started
off denying the claim, I asked him to listen to me for five minutes while I explained our position. After that five minutes of talking he said &quot;you know
what, you are exactly right&quot; we received payment a week later.

Here is food for thought. How many of us have a corporate name that does not involve &quot;towing&quot; or &quot;wrecker&quot;. I wonder if we&#39;d have more
success if we billed under the corporate name and approached the insurance company as the people hired specifically to remove the vehicle from the damaged
property and never once said the word tow. ]]></description>

			<description><![CDATA[ We removed a van from a lake that others would not touch because he only had liability. I told the customer that his property damage should cover it. I used a
completly differant invoice for this job and ommited anything with the words tow or towing. The insurance lady that called me on this was actually very nice
she did&#39;nt belive it would be covered. but When I told her it had nothing to do with the van and everything to do with the lake and the restoration of the
enviroment she said you know what your right.

I had charged the customer around $5000 to recover this van, he was reimbursed for everything except the tow. ]]></description>

			<description><![CDATA[ Richard, thanks for the quick reply. This is not about the money on this recovery. I see this as maybe a chance to set a precedent in our state. I had hoped
that maybe by keeping the cost low, they would not fight and pay it, and therefore open the door for future claims. I guessed wrong because they bowed up real
quick and stopped talking. I just got off the phone with the state ins dept and I am filing a complaint against them for non-payment and it will be reviewed by
the state ins legal dept and get a ruling from them. After that we see what direction to take. Thanks.

approach including not using the word &quot;TOW&quot; at all... Transport is ok, and it all depends on the manner in which the invoices are submitted and to
who...

Now remember the discussion about the court case against Lloyds of London where the &quot;duty to protect&quot; came into play ?

After all, like you said &quot;the resturant could not re-open&quot; without the &quot;public and enviromental hazard removed&quot; and you by removing the
hazard, did mitigate the future loss&#39;s of the business...

That case will be the key in this fight and many more to come... It is very interesting reading and I see it being the key in getting paid (at least for now)
till the insurance companies find a way to get out of this issue...

			<description><![CDATA[ I am getting ready to bow up on this and pursue it. We removed a car from a restaurant play ground area that was enclosed by a wrought iron fence. The car had
only liability ins but had to be removed before repairs could be started or they could even re-open for business. Farmers ins say they do not owe anything for
the removal. They would pay a general contractor if the charges were included in his repair bill, but refuse to pay anything to a towing company. It has been
explained to them that there was no tow bill charged, the billed charges were for property restoration and clean up only. Their manager has stated that they
will not pay or discuss this any further and also will not provide a written statement as to why they take this stand. This is a small claim but I am ready to
take a stand and see where it goes. Any input or ammunition for this fight would be appreciated.

			<description><![CDATA[ so woud this float??? im hoping so at least. Billing charges under cleanup and debris removal for said now three wheeled vehicle, and all of its contents at
the intersection of elm(the tree) and main st. in other words im charging under this clause to remove the busted ass car which is now debris, and the debris
trail that extended from the vehicle. as i see it if i didnt remove said debris (the vehicle) the road would be impassible. so shouldnt it be allowed under the
liability, damage to property clause, and subsequently if i didnt do said recovery of (the vehicle) wouldn&#39;t every state resident, further have a claim
with the insurance carrier, for their inability to use said roadway. ]]></description>

			<description><![CDATA[ While trying to follow this process through on our first casualty we &quot;accidentally&quot; got paid on another. We have no idea why but all of the sudden an
insurance company (liability only) came and picked up a car and paid in full. We are getting a huge run around by the one we&#39;re doing but I&#39;m keeping
on top of it and unfortunately for the insurance company I am not going away. Their latest trick was to fax me a pile of forms that they say they need filled
out so they can continue to process our claim. All of the forms applied to being another driver in another vehicle. I marked them all as &quot;not applicable
to our claim&quot; and sent them all back with all the paperwork, police reports and previous correspondence that I have given them already. They wanted a fax,
I gave them a fax. I&#39;ll continue to post our progress. ]]></description>

			<description><![CDATA[ I have filed on one wreck that involved a camper being pulled by a suv.  The ins co did not seem to understand that the camper can not go down the road and
turn over by itself.  So, I got paid off the suv and filed property damage on the clean-up.  The ins co. wasn&#39;t happy, but I got paid.  The debis that I
cleaned-up was in the medium of a state highway.  The ins co would have paid the state to clean the medium or the utility co. to restore the property to like
before, so why not pay me.  Hope this helps. ]]></description>

the insurance company to pay. Some companies are going as far as restoring the property that was damaged by the incident and charging for it also. They smooth
out ruts, remove broken trees, seed and straw.
